After denial of your claim for either Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI), the first step in appealing that decision is to file a request for reconsideration within 60 days of your claim denial date. If this is unsuccessful, the remaining available steps are:

  • Requesting a hearing before an administrative law judge (ALJ)
  • Asking for your case to be reviewed by the SSA Appeals Council in Falls Church
  • Filing an appeal in U.S. District Court

Appeals are handled online, and many people do not have the computer access or knowledge to submit them properly. Further, no one should go into an SSA hearing without qualified representation. Although this is presented as a non-adversarial process, you will very likely be asked questions you do not know how to answer. Vocational experts may testify that there are many jobs you could perform.
